Overseas Probate

You may be involved in the administration of an overseas estate or an estate with cross border elements. There can be a variety of documents that may be required to deal with cross border estate administration and it is likely that you will need the services of a Notary Public.

The precise requirements will depend on the circumstances of the case and they can vary from simply confirming the identity of someone to more complicated Certificates of Inheritance.

The Role of a Notary in Overseas Probate

In those instances, my role as a Notary Public is to act as the link between England and Wales and the relevant foreign countries. In this role I can assist you, amongst others, with the following legal documents:

  • Property Contracts
  • Deeds
  • Powers of Attorney
  • ID verification
  • Grant of Representations with or without Will
  • Certificates of Inheritance

Certificates of Inheritance may be required by a foreign country so that I can explain, verify or authenticate to a relevant foreign authority the English and Welsh succession or probate rules and how they interact with Private Interactional Law. Cross border estate administration is a complex area of law and individual circumstances can require a Notary Public to confirm or otherwise resolve questions on intestacy or partial intestacy. In particular confirm who would be potentially entitled to assets in other countries.
